Federal law requires applicants like these with excessive foreign ownership to file a petition for declaratory ruling at the same time that they seek FCC approval for the relevant licenses, they must then complete that process before the FCC can approve the assignment of licenses, and that process must enable Executive Branch agencies with national security and specific policy expertise to weigh in.
But in this case, the Applicants decided that they did not need to comply with any of those legal requirements. The Applicants expressly state that they will have foreign investment in excess of the statutory 25 percent benchmark.
Did they file the petition for declaratory ruling required by the Code of Federal Regulations? No, they did not.
Did they obtain approval from the FCC for their excessive foreign ownership? No, they did not.
Did the Applicants afford the Executive Branch agencies with national security and relevant policy expertise an opportunity to consider their application as well as the source and amount of foreign investment? No, they did not.
The Commission has never done this before. So why are we voting for a first-ever fast track today?

Whether or not Biden was actually in “command,” as he put it during a press conference that he coughed his way through before another one of his curt exits, the optics of POTUS lounging on the beach while his fellow Americans waited on rooftops for rescue were awful.
Besides, few people believe Biden is in command of anything anymore. World leaders — particularly Israel’s Bibi Netanyahu, thank goodness — no longer give a rat’s patootie what the Formerly Most Powerful Man in the World™ has to say about anything. So why should his cabinet? Or FEMA?

WELL, GOOD: Taiwanese military report says China lacks full invasion force.
China has stepped up deployments of new types of anti-ship ballistic missiles and ultra-high-speed hypersonic missiles, which will provide opportunities for strikes against foreign military forces in the seas between the Chinese coast and what Beijing calls the “second island chain” — islands stretching from Japan to Guam, the report said.
The report also disclosed that the Chinese coast guard is being bolstered with new weapons and the addition of small warships from the Chinese navy.
But despite China’s overall buildup, the report concludes that China’s current capabilities are not sufficient to move large amounts of forces across the 100-mile Taiwan Strait that would be needed in a military strike. The lack of amphibious forces and supply capabilities for cross-strait warfare means the Chinese military is “not fully prepared to conduct a full-scale invasion on Taiwan,” the report said.
A military source said one of the lessons China has learned from Russia’s invasion of Ukraine is that an assault on Taiwan will be much more difficult than originally anticipated.
Giving China pause gives us time to fix our Navy.

ISRAEL SETTLING ALL THE FAMILY BUSINESS: Third loud blast heard by BBC team.
For those who remain in Dahieh – the Hezbollah stronghold in Beirut’s southern suburbs – it’s becoming a familiar message.
The IDF sent out a fresh warning late this evening, external that residents of three areas needed to evacuate. It meant Israeli air strikes were coming, and less than an hour later we heard two separate attacks.
The second was the louder, a long boom rumbling around the capital, the sound echoing and bouncing off the tall buildings around us.
As I write this update, we hear a third strike. Once again, it’s a tense and frightening night for people in the capital, some of whom are still sleeping out on the streets.
