COUNTDOWN TO THE HARVARD/UNC ORAL ARGUMENT: My fun-loving sister asked me if I planned to have a good time on the 31st. I thought, “Yes!” But then I realized she was talking about Halloween and not the Supreme Court oral arguments in Students For Fair Admissions v. Harvard College and Students For Fair Admissions v. UNC.

But back to the Supreme Court: In the abstract at least, one of the best arguments that race-preferential admissions policies should not survive strict scrutiny is this one: The public strongly opposes them. You’d be shocked at how clear the polls have been on this for many decades.
Why do I think that’s a good argument (even though the Court is extremely unlikely to ever publicly credit it)? The whole point of strict scrutiny is to put the strongest possible thumb on the scale against approving race discrimination. If the public favors a racially discriminatory law or policy, that shouldn’t count for squat. The Court must nevertheless satisfy itself that the interest the law or policy serves is compelling and that the law or policy is narrowly tailored to achieve that purpose. But the other way around is different. If the public opposes the discriminatory law or policy and is instead on the side of race neutrality, it’s not easy to see how nine judges can cast themselves in the role of the High Priests of Justice and drag us kicking and screaming into a policy that has never been adopted by our elected officials. If unelected elites can, consistently with the Constitution, impose race discrimination on an unwilling population, it’s time to lock your doors and bolt your windows.

California Gov. Gavin Newsom signed into a law a bill last week that will change grocery stores throughout the state in the near future. SB 1046, put forth by Sen. Susan Talamantes Eggman, will force supermarkets to phase out single-use plastic produce bags, called pre-checkout bags, that are often seen near the fruits and vegetables section by Jan. 1, 2025.
According to the San Jose Mercury News, stores will have to use recycled paper bags or compostable bags instead.
The bill originally asked that all plastic bags be replaced by 2023. However, in an April letter from the California Grocers Association to Eggman, the association asked the date be changed to 2025 to give stores time to alter their supply chain.

DEMOCRAT CANDIDATE IN OHIO SENATE RACE HAS DEBATE MELTDOWN:
Where [Vance] really hit back against Ryan, though, was by reminding that the alleged criminal in the case of a 10-year-old girl who was raped and became pregnant as a result, was here illegally.
“But let’s talk about that case,” Vance mentioned. “Because why was a 10-year-old girl raped in our community, raped in our state in the first place? The thing the media and Congressman Ryan, they talk about this all the time, the thing they never mention is that poor girl was raped by an illegal alien, somebody that should’ve never been in this state in the first place.” Vance then turned towards Ryan to decry how “you voted so many times against border wall funding, so many times for amnesty, Tim. If you had done your job, she’d never have been raped in the first place.” As the buzzer rang to call time, Vance called on Ryan to “do your job on border security, don’t lecture me on positions I don’t actually have.”
Vance used the moment to hit Ryan not only on abortion, as he did, but on illegal immigration as well, which would also come up at a later point in the debate, with the prevalence of fentanyl in this country and in Ohio.

PIER Plans should describe the activities and strategies that investigators and research personnel will incorporate to promote diversity, equity, inclusion, and accessibility in their research projects. The complexity and detail of a PIER Plan is expected to increase with the size of the research team and the number of personnel to be supported. This will be a requirement for proposals submitted to all Office of Science solicitations, as well as invited proposals from the DOE national laboratories. The PIER Plans will be evaluated under a new merit review criterion as part of the peer review process.”

Beginning in FY 2023, proposals requesting funding to support a conference will require that the host organization of the conference has an established code of conduct or policy in place that addresses discrimination, harassment, bullying, and other exclusionary practices.
