ANTITRUST: A Judge Lets Google Get Away with Monopoly.
The decade-long campaign to stop big tech from dominating our society took a significant step backwards, as the judge hearing the search case against Google, Amit Mehta, chose not to meaningfully constrain the firm’s illegal behavior. And to engage in such deferential behavior, he openly ignored Supreme Court precedent.
You don’t have to take it from me. It’s Mehta who last year found Google to have violated the law. “Google is a monopolist,” he wrote, “and it has acted as one to maintain its monopoly. It has violated Section 2 of the Sherman Act.” It’s also Mehta who found the Supreme Court mandated what he called the “remedial objective” in monopolization cases, to “terminate the illegal monopoly.” But, Mehta wrote, “remedies designed to eliminate the defendant’s monopoly—i.e., structural remedies—are inappropriate in this case.”
So there we go. Mehta understood the law mandates he terminate Google’s monopoly, but he just decided against doing so.

IT’S GOOD TO BE THE NOMENKLATURA: If Lisa Cook Committed Mortgage Fraud, Then It’s a Crime Still in Progress.
Note that the text states that Cook, in the space of two weeks during 2022, claimed two different homes as her main residence; the government alleges that she did this in order to obtain better loan terms. Banks charge a lower interest rate for an owner-occupied primary residence because, should a borrower come under financial distress, lenders assume the borrower will default on an occupied home loan last.
Cook was a public official acting in one of the most important bank supervision roles in all of government. She has been credibly accused, and has not denied, signing two different loan agreements in which she claimed to be entitled to a lower interest rate.
Cook’s lawsuit claims that these mortgage loan documents are old news and are all in relation to things that happened before she became a governor. On the contrary, unless circumstances have changed—and there’s no evidence in the public record that they have—Cook is still paying the lower rate and continues to benefit from the misrepresentations she made on loan documents in 2022. Again, if this is mortgage fraud—and Cook is entitled to the presumption of innocence—then the crime is still in progress.
It does appear to still be in progress, putting lie to Cook’s claim that “private conduct before taking office does not amount to cause.”

DECLINE IS A CHOICE (LEFTIES ARE HAPPY TO MAKE ON YOUR BEHALF): The national security case for nuclear energy in Colorado.
While a real-life ‘Red Dawn’ scenario playing out is unlikely, with Soviets falling from the skies and taking over Colorado, the threats to national security posed by Colorado’s current decarbonization agenda are very real.
Colorado is home to some of the United States’ most important national security assets, including the U.S. Space Command, the North American Aerospace Defense Command (NORAD), and many aerospace and defense contractors. The installations run by these assets require a dependable energy source in order to monitor threats, operate satellites, and carry out functions to protect the nation.
But as the state continues towards an unrealistic climate goal of 100% decarbonization by 2040, an important issue is raised: Can Colorado’s renewable energy scheme dependably support the infrastructure essential to national security?
The current sources, specifically wind and solar and their susceptibility to extreme weather and foreign interference, put these essential defense functions at risk. Nuclear energy offers both a green and reliable alternative.
Colorado has set one of the most ambitious clean energy goals in the country with a 100% decarbonization mandate by 2040. This aggressive plan includes the retiring of all 6 remaining coal plants by 2031, the addition of 3,400 megawatts of wind energy, 1,970 megawatts of solar energy, 1,170 megawatts of energy storage. Furthermore, 82% of new passenger vehicles sold must be electric or plug-in hybrid by 2032.
If Colorado continues to increase its dependence on wind and solar energy, the state is setting itself up for a potential power crisis.
After 30-plus years, I should be gone from Colorado long before the worst of Denver’s decarbonization efforts kick in.

Carlos Carvalho, president of the University of Austin, welcomed new students — this is the private school’s second year — with a speech defending inequality.
“Of course, all men are created equal,” said Carvalho, who was a professor of statistics in the business school at the University of Texas in Austin. “But all men are not the same. We have unequal curiosity, unequal intellect, unequal talent, unequal courage, unequal drive, unequal achievement.”
Alexis de Tocqueville, the great 19th century critic of American democracy, warned that “a dominating drive for equality suffocates the very people whose uncommon talent, courage, and vision could pull everyone else upward,” said Carvalho. He “famously observed that people in democracies might come to prefer equality in servitude to inequality in freedom. In the name of making all things equal, we end up equal only in mediocrity.”
If excellence were the norm we’d have to call it something else.

LOVIN’ IT: Coming price cuts at McDonald’s may signal a broader fast food price war.
McDonald’s is cutting prices on some combo meals to woo back customers who’ve been turned off by the rising costs of grabbing a fast food meal.
The price drop may induce its rivals, who have run into some of the same pricing issues, to follow.
Starting Sept. 8, McDonald’s will offer Extra Value Meals, which combine select entrées like a Big Mac, an Egg McMuffin or a McCrispy sandwich with medium fries or hash browns and a drink. Prices will vary by location, but McDonald’s said Extra Value Meals will cost 15% less than ordering each of those items separately.
To kick off the promotion, McDonald’s will offer an $8 Big Mac meal or a $5 Sausage McMuffin meal for a limited time in most of the country. Customers in California, Alaska, Hawaii and Guam will have to pay $1 more for those meals.
I don’t eat much fast food anymore — mostly due to middle-age concerns — but this is some welcome price relief.

Schools have decided that facts are no longer worth teaching.
In many classrooms today, the very idea of committing information to memory has become unfashionable. As I tour schools for my daughter, we are often assured that facts will surely not be the focus of her education. “We don’t do rote memorization,” teachers proudly declare with a condescending wink. As if memorization were an outdated relic of a less enlightened era.
But without facts, what are students actually learning?
At the progressive Brooklyn private school where I once taught, spelling wasn’t corrected until middle school. Focusing on spelling, we were told, got in the way of creativity.
I then watched smart, curious kids write macien for machine at age 14, then wilt when people involuntarily gasped at their failed spelling attempts. Their writing was often expressive and insightful . . . and incoherent. They probably weren’t even aware of the $60,000 per annum price tag, or they might have raged against that macien.
Math was treated with the same flippancy. Curious about the curiously low standardized test scores, I once wandered into a math classroom where the teacher was barefoot, in a faded Led Zeppelin T-shirt (it was a great shirt). He then drew a circle on the board and announced, “This is not a circle. It’s a representation of a circle.” The lesson, it seemed, was to gain mystique points by using a stoner voice to say something quirky. I couldn’t help but make a connection between that math lesson, and the school’s undying demand for expensive private tutors.
