HIGHER EDUCATION BUBBLE UPDATE: John Hinderaker: Down with College!

For the last 50 years or so, public policy in the U.S. has trended toward the view that everyone, more or less, should go to college. This was a sharp departure from the historical norm, when higher education really was higher, and only a small minority obtained four-year degrees.

It has become increasingly evident that the payoff for sending most kids to college is minimal, both for them and for our society and economy. Hence the current trend away from four-year colleges and toward, among other things, apprenticeships. The Wall Street Journal has a long article headlined “More Students Are Turning Away From College and Toward Apprenticeships,” with the subhead “Some white-collar training programs have become as selective as Ivy League universities.” That can only be a good thing. . . .

The Journal doesn’t discuss this factor, but it seems obvious that one reason for the anti-college trend is the wokism that has infected virtually all colleges and universities. Higher education is now, in most cases, a hostile environment for young men, and it is rapidly becoming a hostile environment for normal people, generally. So why should most kids–the ones who aren’t going to be doctors, engineers, and a handful of other occupations–shell out a lot of money for a poor education?

I was one of the last defenders of traditional liberal education, but I finally threw in the towel because actual liberal education is just about extinct.

Indeed.

GOOD: In NCLA Win, Federal Judge Rejects Motion to Dismiss in Government-Induced Censorship Lawsuit.

Judge Terry A. Doughty of the U.S. District Court for the Western District of Louisiana has denied government defendants’ motion to dismiss in State of Missouri, et al. v. Joseph R. Biden, Jr., et al. The New Civil Liberties Alliance, a nonpartisan, nonprofit civil rights group, represents renowned epidemiologists Drs. Jay Bhattacharya and Martin Kulldorff, as well as Dr. Aaron Kheriaty and Ms. Jill Hines, in a lawsuit that has exposed an elaborate, multi-agency federal government censorship regime. Judge Doughty wrote, “The Court finds that the Complaint alleges significant encouragement and coercion that converts the otherwise private conduct of censorship on social media platforms into state action, and is unpersuaded by Defendants’ arguments to the contrary.”

Discovery in the lawsuit unequivocally establishes that at least eleven federal agencies and sub-agencies, including CDC and DHS, directed social media companies to censor viewpoints that conflict with the federal government’s messaging on topics ranging from Covid-19 to elections. Federal officials engaged in a lawless, expansive censorship campaign that employed illicit tactics—including coercion, collusion and coordination—on social media companies to suppress the airing of disfavored perspectives on Covid-19 and other topics. As a direct result of state action, NCLA’s clients were blacklisted, shadow-banned, de-boosted, throttled, and censored, merely for articulating views opposed to government-approved views on Covid-19 restrictions and regulations. Judge Doughty held that “Plaintiffs have plausibly alleged state action under the theories of joint participation, entwinement, and the combining of factors such as subsidization, authorization, and encouragement.”

In confirming Plaintiffs’ standing, Judge Doughty said, “The threat of future censorship is substantial, and the history of past censorship is strong evidence that the threat of further censorship is not illusory or merely speculative.” Judge Doughty also found Plaintiffs’ alleged injuries-in-fact are “redressable by the Court,” and that Plaintiffs had demonstrated sovereign immunity does not bar their First Amendment, ultra vires, or APA claims.

NCLA looks forward to continuing to litigate this vitally important First Amendment case before the Court.

Elite law schools have become training academies not so much for effective and competent lawyers, but instead for militant transformational radicals with a law degree.

Mainstream consumers of legal services, otherwise known as paying clients, would be shocked by the evolution that has taken place in the nation’s elite law schools. Instead of producing lawyers capable of helping clients, these schools now turn out leftist activists who are most competent at using transformational designs to upend centuries of legal traditions and institutions, including, ultimately, the U.S. Constitution itself.

This problem isn’t new. But the shocking behavior at Stanford by rude, belligerent proto-totalitarian students shouting down a federal judge laid bare this rancid evolution for everyone to see.

The next generation of lawyers at these schools isn’t focused on learning contracts, torts, civil procedure, and evidence as much as they are learning how to destroy treasured American institutions such as tolerance, liberty, and free speech.

Conservative entertainment critic Christian Toto told Fox, “The Superman motto restoration is a very minor item, but it didn’t happen in a vacuum. Hollywood is slowly realizing how off-putting woke theatrics can be, and the Biden economy is making studios pinch pennies in every possible way. If that means appeasing a huge swath of comic book fans eager for an old-school, all-American Superman, so be it.”

He also said, “We also saw this in the mostly apolitical Oscars ceremony. The message is finally hitting Hollywood. Stop dividing us and take a knee in the culture wars.”
