THE DOBBS SUPREME COURT LEAK: “There’s such a lack of confidence in institutions, and this leak will only serve to make matters worse. This is a bullying move. The Court should not succumb to bullies.”
OPEN THREAD: Why ask your head, it’s your hips that are swinging.
UPDATE (FROM GLENN): A friend comments: “Whatever position you may have on the issue, leaking a draft SCOTUS opinion to try to change the outcome of a case is a new level of brinksmanship that speaks to the hyperpoliticization of law schools and an accompanying valorization of ‘activism’ in higher ed.”
Assuming this was leaked by a clerk, the leaker should never work in law again. It’s a betrayal of the highest order. But, of course, professionalism has proven to be weak sauce indeed when it comes to restraining activism.
More thoughts from Josh Blackman. “The Court should issue the Dobbs opinion as soon as possible. Do it tomorrow. Don’t wait till Thursday, or next Monday, or the end of June. The longer this process drags on, the worse the Court will be . . . if any members of the majority changed their vote in response to the leak, that change will be seen as a direct response to this leak.”
Here’s more, including the draft opinion, at the Washington Examiner.

When the backlash hits, I predict that Politico will become sudden First Amendment absolutists.
From the comments: “That can’t be right. I was told the Responsible Gatekeeper Media did not report on or print information that was leaked or hacked.”

Of course, to be fair, though everyone seems to assume the leak came from someone on the left, we don’t know for sure.

Prediction: The people who accused Trump of “incitement” will have differing standards here.
Plus, from a friend:
Biden could immediately order additional protection for all Supreme Court justices
Garland could immediately order a criminal investigation into the leak
Roberts could order the immediate release of the actual Dobbs opinion
Each of these acts would have the effect of insulating the Court from the intended, potentially violent, political pressure. We’ll see if any of them does any of these things.
We will.
QUOTE OF THE DAY:
One of the many disservices done to young people by our schools and colleges is giving them the puffed-up notion that they are in a position to pass sweeping judgments on a world that they have barely begun to experience.

K-12 IMPLOSION UPDATE: DC elementary school gives 4-year-olds books to report racist family members.
A Washington, D.C., elementary school is under fire after instructing students as young as 4 years old to go home and identify racist family members.
Students from pre-K through third grade at Janney Elementary School attended an “Anti-Racism Fight Club” presentation with speaker Doyin Richards, according to a letter from the principal of Janney Elementary School, Danielle Singh, written on Nov. 30, according to a report.

“Anyone else’s Kindergarten kid freaked out by an anti-racism assembly today? My kid needed to sleep with a light on and the door open tonight,” one parent posted anonymously to the “DC Urban Moms and Dads” online forum. “Anyone know what specifically was talked about? My kid couldn’t relay much except that she was scared.”
Not only are people taking issue with the book’s rhetoric, but the at-home activities the book prescribes are also causing tension, according to the report.
Reading the book “isn’t a spectator sport” and requires “being loud, uncomfortable, confrontational and visible to ensure change is made,” Richards writes.
One such activity involves a series of questions that asks the students, “Where do you see racism in yourself? This requires true soul-searching. Be real with yourself, don’t feel guilt/shame and own it. It’s the first step in becoming an anti-racist.”
In the section, “How to deal with racism from loved ones,” Richards’s work instructs the young readers that “just because someone is older than you doesn’t mean that they’re right all of the time.”
“If someone doesn’t believe that people should be treated equally based on the color of their skin, then they are the problem. Parents need to stop making excuses for that behavior if they truly believe in anti-racism. … Who in your family has racist beliefs? Do you think you can change their ways? What is your strategy for dealing with them?”
“‘You’re a traitor!’ yelled the boy. ‘You’re a thought criminal! You’re a Eurasian spy! I’ll shoot you, I’ll vaporize you, I’ll send you to the salt mines!’ Suddenly they were both leaping around him, shouting ‘Traitor!’ and ‘Thought-criminal!’, the little girl imitating her brother in every movement. It was somehow slightly frightening, like the gamboling of tiger cubs which will soon grow up into man-eaters.””

#JOURNALISM: Docs: Prominent Journo Showed Draft of Narrative-Driving Russiagate Story to Oppo Firm.
In the lead-up to the 2016 presidential election, the high-profile Washington reporter Franklin Foer, according to recently-published documents, did something that would, in all likelihood, get an intern run out of town: He showed a full draft of an unpublished story to one of the co-founders of Fusion GPS, the Democratic-allied research firm notorious for producing a dubious dossier containing the claim that Donald Trump was being blackmailed by the owners of a “pee tape.” More troublingly still, this isn’t the only time Foer has contravened a fundamental journalistic norm—or the only time his editors have apparently let it slide.
Foer is a fancy, connected, and well-known journalist, formerly the editor of The New Republic and currently a staff writer at The Atlantic, who is working on what will presumably be an insidery and well-sourced book about the first 100 days of the Biden administration. The brother of famed novelist Jonathan Safran Foer and author of ponderous, well-reviewed books like How Soccer Explains the World, he’s the sort of journalist whose dispatches set the tone not just for what will be covered by, but how it will be covered in, the elite centrist press. Throughout the summer and fall of 2016 he was far ahead of most of the mainstream press in forwarding the theory that Trump was in essence a Russian agent, publishing conspiratorial articles with headlines like “Putin’s Puppet” and “Was a Trump Server Communicating With Russia?”
Last fall, Foer was at the center of a mini-scandal in the Fox News cinematic universe. Court documents filed in relation to the indictment of Hillary Clinton campaign lawyer Michael Sussman on charges of lying to the FBI appeared to show that Foer had sent the first 2,500 words of a draft of that second, highly influential article to Fusion GPS—the opposition-research firm behind the infamous “Steele dossier”—ahead of the article’s publication on Slate on October 31, 2016. The firm, the court filings revealed, had told him it was “time to hurry,” at least suggesting that it wanted the unconvincing conspiracy theory to be published ahead of the November 8 general election, in time to influence the results, and that Foer was serving as its catspaw. . . .
That brings us to this week, when the blog The Reactionary published documents appearing to show in black and white that in June 2016, Foer in fact ran the entire draft of a story by one of the co-founders of Fusion GPS before publishing it at Slate. One email shows a file called “Manchuriancanidate.foer” attached; given the timing, it seems highly likely that this is a version of the story that eventually ran under the headline “Putin’s Puppet” on July 4, 2016.
