Berkeley law school) on the constitutional limits to Congress’s power to create intellectual property rights. You can read it here if you’re so inclined. There have been lengthier treatments of this subject published since, but this one has the advantage of being (1) earlier; and (2) shorter. You’ll probably find advantage (2) more significant.
