THE ABA SHOULD DROP DEAD, AND SHOULD CERTAINLY BE STRIPPED OF ANY ACCREDITATION ROLE FOR LAW SCHOOLS: ABA Tries Again With Legal-Ed Diversity Rule.

Three tentative thoughts.

First, the ABA really should wait to see what the Supreme Court does in the Harvard case. The Court very well may blow up affirmative action as we know it. Any effort to draft a rule ahead of Harvard is a mistake.

Second, as I read the rule, faculty members would be required to undertake mandatory DEI training.

Third, the protections for religious institutions are limited to “essential elements of its religious values and beliefs provided that its actions are protected by the United States Constitution.” This standard is cut very thin. Given Employment Division v. Smith, it isn’t clear that this interpretation provides any protections at all.

State legislatures should be cutting the ABA out of any role in legal education in their states.

ELIZABETH WARREN JUST BLAMED HIGH GAS PRICES ON CORPORATE GREED. HERE’S WHY THAT DOESN’T MAKE ANY SENSE:

The true causes of high gas prices are complicated, and ultimately, prices are set by supply and demand—not by the whims of individual companies. (Otherwise, they’d always set them as high as they could. But other suppliers and customer demand keep companies’ prices in check). Today’s high gas prices are influenced by international market dynamics involving OPEC, supply chain issues created by government pandemic restrictions, federal policies restricting the energy sector, and the Federal Reserve’s rampant money-printing that is fueling widespread consumer price inflation. So, too, some of the current increase represents a correction after 2020, a year of lockdowns, which saw unusually low demand for gas and even negative oil prices at one point.

Having “shut down oil and gas leasing on federal land and directed executive agencies to eliminate spending that serves to subsidize fossil fuel industries. Even as benchmark crude prices increased, Biden’s policies forced developers to abandon transit pipelines such as the Keystone XL pipeline, among others:” Biden orders release of 50 million barrels of oil to drive down gas prices.

FAKE IT TIL’ YOU MAKE IT: Perhaps Rep. Bennie Thompson (D-MS) has been taking legal lessons from the same crew who ginned up the “Steele Dossier” to get FISA warrants used against Carter Page, et. als. JustTheNews has a blockbuster report out this morning, where the journalists used cellphone and toll booth records to prove that Rep. Thompson’s signed subpoena was based in part on a wholly fabricated source.

The Jan. 6 commission in Congress made headlines when it issued a subpoena citing “credible evidence” that on the day before the Capitol riot, former New York Police Commissioner Bernard Kerik attended a meeting at the Willard Hotel in Washington where Trump advisers discussed how to overturn the November 2020 election. The subpoena was supported by a citation to Bob Woodward’s book “Peril.”

Except for one eensie weensie minor detail:

Kerik was 300 miles away in the New York City area on Jan. 5, 2021, according to his own car’s toll booth records reviewed by Just the News. He left Washington the night of Jan. 4 and did not return until the morning of the riots, according to Kerik’s own account at a speech this weekend in Chicago. And that book by Woodward? It makes no claim about Kerik attending a meeting at the Willard on Jan. 5. In fact, the book doesn’t even mention the former NYPD commission once in its 482 pages.

Reporter John Solomon went as far as fact-checking with Woodward himself. Maybe Thompson had a different edition? Maybe Solomon was missing something? Nope:

Woodward and his coauthor, fellow Washington Post journalist Robert Costa, confirmed to Just the News in a statement Monday night that they did not allege Kerik attended a Jan. 5 meeting at the Willard. “The subpoena for Mr. Kerik references page 234 of our book, ‘Peril,'” the Post journalists said. “That page, however, does not mention Mr. Kerik in any way. In fact, he is not mentioned anywhere in our book.”

Making up facts to obtain a subpoena? There oughta be a law!

It’s amazing how quickly bad (i.e. Democrats’) leadership can ruin things. The problem with gas prices is that the press can’t cover that up since it’s right on the pump.

I ONCE WOULD HAVE FOUND THIS IMPLAUSIBLE, BUT NOW AFTER WHAT THEY DID TO TRUMP . . . Watergate revised: Prosecutor cover-up alleged.

It’s taken decades of work, but a former aide’s campaign to clear Richard Nixon’s name in the 1972 Watergate scandal has finally reached the Justice Department, with the aide seeking an investigation into allegations of prosecutorial misconduct and a “deep state” conspiracy to take Nixon down.” . . .

Shepard’s credibility is hard to challenge. He was an insider who turned on Nixon after hearing one of the most critical secret tape recordings in the Watergate case. In fact, he is credited with dubbing the tape the “smoking gun” because he believed it tied Nixon to the Watergate cover-up.

Only later did Shepard change his mind when he realized that Nixon was running through options in the scandal, not approving a hush payment in the case.

And more recently, he forced the release of the secret prosecutor’s “road map” used to convince a grand jury to indict key Watergate figures and egg on the impeachment inquiry that turned out to be a hoax, somewhat similar to the “dossier” used to spark the FBI investigation of former President Donald Trump.

“They knew it was a lie, and they made it up,” Shepard said. That road map, however, was never revealed to Nixon’s defense team and was sealed until 2019, when Shepard got it released. It is a central piece of his latest book, published by Bombardier Books.

He also found out that several members of the Watergate Special Prosecution Force, then headed by prosecutor Archibald Cox, improperly left the group with their documents. In some, they described how they worked with the anti-Nixon judge in the case, John Sirica, to get Nixon — a big legal no-no.

Like I say, knowing what we know now about how our institutions work, it’s a lot more plausible than I once would have believed.
