Despite the governor’s consistent claim that she was making science-driven decisions, her team of lawyers had no answer for the federal judge when pressed for the data supporting specific provisions of some executive orders.
Maloney emphasized that the bar he faced to uphold Whitmer’s executive orders was extremely low but not zero. He said also that the bar was very high for him to grant the gym owners’ request to let them reopen.
“Plaintiffs [gym businesses] must show that there is no conceivable set of facts from which a rational relation can be drawn,” the judge stated.
“Plaintiffs only argue … the continued closure of gyms is arbitrary and unreasonable because gyms are basically the only category of businesses that remain closed in Michigan, and because the State has not put forward any scientific data that supports keeping gyms closed while opening other closely similar activities and businesses, such as swimming pools, restaurants and bars, and ‘personal touch’ services like salons,” the judge wrote.
And then, the judge stated how little evidence Whitmer’s team would have to produce to win the lawsuit.
“Rather, this Court must uphold the Governor’s Executive Orders as long as they are supported by some relation to the public health.”
Maloney then emphasized how far short Whitmer’s lawyers fell of even that low standard.
“Unfortunately, on the record before it, the Court has not been presented with any evidence that shows a rational relation between the continued closure of indoor gyms and the preservation of public health,” he wrote. “While the standard is extremely deferential here—if the Court can conceive of any set of facts that would support the Orders, it must uphold them and deny the injunction—the Orders must still connect the challenged prohibition with some fact or facts.”
The judge’s rebuke also described how, in oral arguments, the governor’s lawyers struggled to produce any data or science supporting her position.
Bullshit is not science.
CASES ARE UP, BUT DEATHS ARE DOWN: Guess what the press is talking about. “Worse than that, rather than share the actual factual data, they are now selling you stories that are simply not true.”
So, yeah, it was a garage pull that had been there since 2019. While this might not be a Jussie Smollett-like hate crime hoax, it’s nevertheless an unfortunate situation. Bubba Wallace may have jumped to the wrong conclusion upon seeing the garage pull, or he saw it and decided to take advantage of the current racial hypersensitive climate to pronounce himself a victim. I want to give Wallace the benefit of the doubt here, but it’s difficult to do that when Wallace seemed so determined to play the victim, and said those who questioned the story were “simple-minded.”
So far, Bubba Wallace hasn’t released a statement in response to the investigation concluding. Without a doubt, he needs to apologize for jumping to the wrong conclusion.

TIME FOR REPUBLICANS TO STAND UP?
Leading Republicans do not seem to understand that George Floyd’s death was the excuse for the current crisis, not the cause of it. The chaos in our streets—led by BLM, supported by Democrats, and propelled by higher education—is for all intents and purposes an effort to destroy the American way of life. Almost all Republicans, however, are stupefied, spectators to this tragedy.
“We’re trained Marxists,” Black Lives Matter co-founder Patrisse Cullors has proudly admitted. On CNN just the other day, Cullors said emphatically, “Our goal is to get Trump out”—not in November, but “immediately.” BLM is on record in 2016 marching to the tune of “Pigs in a blanket. Fry ’Em Like Bacon! KILL THE COPS.” Today, BLM is the drum major in the Democrats’ band. BLM calls for the destruction of our history and the traditional family, the dismantling of “cisgender privilege,” open borders, reparations, socialism, and of course, abolishing the police. When Biden and “mainstream” Democrats get off their knees, they will not be able to resist falling into step.
Unlike Democrats, Republicans do not kneel before their captors, but they are certainly not standing up to them.
On the one hand, this is right. On the other hand, I think Trump is pursuing a sort of rope-a-dope strategy, drawing the Democrats out to full stupid extension, that is very likely to succeed.

The tiny state of Rhode Island announced that because some people are too stupid and too dense to understand that some words have several meanings, they will change the official name of their state.
The “official” name of the state is “The State of Rhode Island and Providence Plantations.” But to those choosing to be ignorant — or those who really are — “plantations” means “a usually large farm or estate, especially in a tropical or semitropical country, on which cotton, tobacco, coffee, sugar cane, or the like is cultivated, usually by resident laborers.”
But in the context as it was originally intended, “plantations” referred to a new colony. But what does context matter when there are dragons to slay? It has been decided that we should choose to remove context and substitute personal interpretation of meaning.

UPDATE (FROM GLENN): It seems to me that if these people can assess Trump’s mental health without examining him, it would be just as fair for people who aren’t their patients to file complaints with the medical or psychological ethics boards for this malpractice. After all, what they’re doing is politicizing and diminishing the reputation of their professions, which means they’ll be less trusted, which means some people who need help won’t seek it out and people will die!!! as a result.
