DUE PROCESS: IT’S NOT JUST FOR JIM ACOSTA AND MICHAEL AVENATTI! Title IX regulation would mandate cross-examination, use same evidence standard for students and faculty.

I’m actually not convinced that Title IX either requires or empowers universities to regulate student (or faculty) sexual behavior at all. All the actual statute says is this: “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.” Everything else has been a superstructure of interpretations and arguments far-removed from this language or its original purpose.

CHANGE: On top: Best economy in 19 years, highest confidence in 14.

A remarkably low 13 percent are calling President Trump’s economy a problem as confidence is hitting a 14-year high, and seven in 10 said 2018 is a good time to find a quality job.

The key points from Gallup’s just-published economic survey:

Economic Confidence Index at +31 in November, remaining at its highest since 2004.
55 percent rate current economic conditions positively.
Record-tying 68 percent say it is a good time to find a quality job.

“It has been nearly two decades since Americans have been as positive about the U.S. economy as they are now,” Gallup said.

Good.

HMM: McCarthy, other Republicans back Ratcliffe to be next attorney general. “Ratcliffe, a former U.S. attorney for the Eastern District of Texas, is one of several people mentioned as possible contenders to succeed Jeff Sessions, who resigned under pressure from Trump last week. Other names in the mix include Florida Attorney General Pam Bondi and former New Jersey Gov. Chris Christie.”

UNDERSTANDABLY: Former Gov. Rod Blagojevich, writing from prison, urges Mitch McConnell to move the criminal justice reform bill.

As readily accessible inside as outside the prison library, these observations aren’t new. What is new comes from the firsthand account that Blagojevich offers. It is his writing about the sad-eyed mothers holding the hands of their sons, his telling of the incarcerated fathers unable to hug their children, his account of an older inmate unable to mourn his wife at her funeral.

“For the past nearly seven years, I have served time with well over a thousand inmates. I have come to know many of them. While almost all of them are in one way or another guilty of the crimes they are here for, and should most certainly be held accountable, I have been surprised by what I’ve learned,” Blagojevich insists. “A large number of these men are not bad men. I believe a lot of them if given another chance can do good.”

And when you remember that the sentencing changes in the law are not retroactive, you realize that the legislation he is pushing isn’t likely to help Blagojevich. He isn’t writing to improve his own conditions.
