A FEDERAL COURT MAY SOON RULE THE CONSUMER FINANCIAL PROTECTION BOARD UNCONSTITUTIONAL: Don’t recognize the name? Despite being President Obama’s biggest gift to Elizabeth Warren, the CFPB has mostly flown under the radar since its creation in 2010. That could change soon because of the U.S. Court of Appeals for the District of Columbia, which is hearing a constitutional challenge to CFPB’s legitimacy.

“Critics of CFPB have noted it is the only agency not accountable to congressional oversight and therefore violates the separation of powers set down by the Constitution. That principle provides that Congress have checks over the executive branch agencies like CFPB. Those checks do not apply to the agency,” reports Richard Pollock of the Daily Caller News Foundation Investigative Group.

Created by a Democratic Congress, CFPB was purposely put under the Federal Reserve to get it out of the reach of congressional oversight. Congress doesn’t even have the power to set the bureau’s budget because it is funded entirely via the Fed. Pollock has been putting an investigative spotlight on the bureau for several years, as seen here, here and here.

If the three-judge appeals court panel rules against CFPB, the bureau will appeal to the full Appeals Court, which has a majority of judges appointed by Presidents Obama and Clinton. Next stop will then the U.S. Supreme Court, so stay tuned.

CIVIL RIGHTS UPDATE: Taxing $1,000 per Gun Became a Reality in One U.S. Territory — and Some Worry It Could Spread.

Gov. Ralph Torres signed the gun tax and regulation bill into law Monday and stressed that his first priority is the safety of law enforcement and the community.

“It’s something that none of us want, and we want to make it as strict as possible,” Torres said in a statement.

Grover Norquist, president of Americans for Tax Reform, blasted these as examples of the left targeting guns and noted that Democratic presidential candidate Hillary Clinton has backed taxes on guns in the past.

“The left is now seeking to tax guns out of existence,” Norquist said in a statement Monady. “The Second Amendment makes it difficult to legally ban guns, but Hillary has led the way to explaining you can achieve the same thing with high taxes.”

There must be a solid case to be made that a $1,000 tax on a $500 pistol is an unconstitutional infringement on a court-recognized individual right.

21ST CENTURY MEDICINE: The cheap, simple way to prevent blisters.

All it takes is some paper tape applied to the foot in blister-prone areas before running, the researchers said.

To test this blister-prevention method, the researchers recruited 128 runners who were participating in a 155-mile (250 kilometers) ultramarathon in 2014.

The researchers applied paper tape to just part of each runner’s foot, so that the untaped areas would serve as a control. At the end of the race, which took seven days, only 30 runners (24 percent) had any blisters in the taped areas, whereas 81 runners (63 percent) developed blisters in the untaped areas.

I’m not a runner, but I’ve found that a good pair of hiking boots is usually all it takes to avoid blisters on mountain camping trips. For longer hikes, try wearing a pair of thin dress socks under your athletic socks.

The National Space Society takes great pleasure in announcing that its 2016 Robert A. Heinlein Memorial Award has been won by acclaimed science fiction author Dr. Jerry Pournelle. This prestigious award selected by an international vote of NSS members will be presented to Dr. Jerry Pournelle at the 2016 International Space Development Conference (ISDC). The public is welcome to attend the conference and see the award presentation at the Sheraton Puerto Rico Hotel and Casino in San Juan, Puerto Rico. The ISDC will run from May 18-22, 2016. . . .

This award is presented once every two years for lifetime achievement in promoting the goal of a free, spacefaring civilization. The winner is decided by the vote of the entire NSS membership, not by the awards committee. The award consists of a miniature signal cannon, on a mahogany base with a black granite inlay and a brass plaque as shown. The award concept came from Robert Heinlein’s classic book The Moon is a Harsh Mistress. Some of the early award winners include Sir Arthur C. Clarke, Carl Sagan, Neil Armstrong and Elon Musk.

It’s richly deserved. In particular, Jerry carried the torch during the dark post-Apollo/Jimmy Carter days. Much of what’s happening in commercial space owes its existence, in part, to Jerry’s writing in that era.
