TODAY IN PROSECUTORIAL MISCONDUCT: Jonathan Fleming, convicted in killing despite vacation alibi, freed after 24 years.

At his trial, defense lawyers provided family photos and home videos of Fleming in Florida around the time of Rush’s killing. But according to Taylor Koss, another of Fleming’s lawyers, they did not have evidence he was in Florida on the day of the slaying. The prosecution persuaded jurors to ignore the alibi.

Fleming told his attorneys he had paid a bill for phone calls made from his Florida hotel room the night before Rush was killed, and he believed the receipt was in his pocket when police arrested him. But authorities told the defense he had no such receipt, according to Koss.

In the course of the investigation, the Conviction Review Unit found the receipt in police records, time stamped and dated — solidifying Fleming’s claim that he was in Florida at the time of the killing, according to the district attorney’s office.

“This is proof of alibi that was basically purposely withheld,” Koss said.

The review unit also interviewed Fleming’s former girlfriend, who said she called Fleming the night of the killing while he was still at his hotel in Florida. The investigation found her story to be credible, with phone records to support it.

The prosecution also produced a witness who said she saw Fleming commit the crime.

According to Koss, the woman recanted her testimony weeks after Fleming’s conviction. She later testified in front of a judge that she was on parole and had been arrested with another woman for being in a stolen van the night of the killing. She said police persuaded her to give a statement against Fleming to avoid going back to jail.

Stuff to remember, should you find yourself on a jury. Meanwhile, of course, this means the real killer — whom a witness identified — was never punished.

ASHE SCHOW: Democrats Are Losing Ground In The War On Women.

It appears Democrat attempts to use Equal Pay Day as an opportunity to knock Republicans as waging a “war on women” totally fell flat.

For years, President Obama and Democrats have been trotting out the “77 cent” figure to claim that women earn less than men, even in the 21st century. And any conservatives who pointed out that the figure was highly misleading were called anti-women or liars.

But it turns out that much of the media didn’t buy into the Left’s claims. Because, as you might expect, the “77 cent” figure is, in fact, misleading. The Washington Post’s Fact Checker gave Obama two Pinocchios for the claim. For years, the Post had given Obama one Pinocchio for the statistic, but since Obama refuses to stop using the number, a second Pinocchio was awarded. The Post considered giving three Pinocchios.

The bigger problem for Obama and Democrats, as the Post’s Nia-Malika Henderson pointed out, is that the White House couldn’t escape reports that women were paid less in the West Wing.

Using the same average, across-the-board accounting used to arrive at the 77 cent figure, women in Obama’s White House make 88 cents to the dollar that men make. And while White House press secretary thinks that’s fine because it’s higher than the national average. But it’s less than the D.C. average.

CBS and CNN also pointed out the White House wage-gap hypocrisy.

The White House further shot itself in the foot by releasing an infographic about the wage gap that featured two cartoon women dressed straight out of “Mad Men.”

But claims linking the latest blizzard, drought or hurricane to global warming simply can’t be supported by the science. Our warming world is, according to the United Nations Intergovernmental Panel on Climate Change, increasing heat waves and intense precipitation in some places, and is likely to bring more extreme weather in the future. But the panel also said there is little evidence that this warming is increasing the loss of life or the economic costs of natural disasters.

Bill Haslam signs knife rights bill. “Tennessee Governor Bill Haslam has signed SB1771, Knife Rights’ bill repealing the state’s antiquated ban on switchblade (automatic) knives and possession of knives over four inches in length ‘with intent to go armed,’ a vague law subject to abusive interpretation. As of July 1, 2014, there are no longer any per se illegal knives in Tennessee. Last year Knife Rights passed Knife Law Preemption in Tennessee ensuring that no local jurisdiction can have regulations more restrictive than state law. This means that existing restrictions that banned automatic knives or limited blade length in some cities are now rendered null and void and they cannot pass any new laws banning certain knives.” Note that the law doesn’t take effect until July 1.
