WHETHER OBAMA OR ROMNEY BECOMES THE NEXT PRESIDENT, EPA IS GOING TO BE HEADACHE CITY: Sen. Jim Inhofe, R-OK, wants to know why EPA is flouting the federal law requiring the agency to post its regulatory plans every six months. And Mark Levin’s Landmark Legal Foundation just sued EPA seeking documents about that regulatory agenda before they are disappeared, as has happened before. Read all about it here.

HIGHER EDUCATION BUBBLE UPDATE: Denial Is Not A Strategy. “Tierney’s missive does provide some valuable insight, albeit unintentionally: higher education is in bad need of reform and faces a potential fiscal cliff because it has increasingly been dominated by people who think like himself. Such denial and intransigence in the face of drastically changing circumstances undermine academia’s claim to intellectual primacy and wisdom beyond that possessed by the average man—or even equal to the wisdom of the average person.” Academics like to think of themselves as more like scientists, but most are more like clergy.

LEGAL EDUCATION UPDATE: Jury Splits in Conservative Faculty Candidate’s Hiring Bias Suit Against Iowa Law School. “A federal jury rejected Teresa Wagner’s First Amendment claim that the University of Iowa College of Law denied her a faculty position due to her conservative politics, but deadlocked over her Equal Protection claim that she was passed over in favor of less qualified candidates. The U.S. Magistrate Judge declared a mistrial on the 14th Amendment claim.” As is typical with such things, though, what came out in discovery was devastating.

GREG LUKIANOFF IN THE NEW YORK TIMES: Feigning Free Speech on Campus. “Colleges and universities are supposed to be bastions of unbridled inquiry and expression, but they probably do as much to repress free speech as any other institution in young people’s lives. In doing so, they discourage civic engagement at a time when debates over deficits and taxes should make young people pay more attention, not less.”
