CORRECTING JOSH MARSHALL: “I love this notion that if people stop taking something seriously, it ceases to exist.” I haven’t taken Josh Marshall seriously in years — since he dripped scorn on me at the Harvard blog conference in 2003 for suggesting, correctly as it turned out, that the Plame leaker might be someone other than Scooter Libby — but nonetheless, Josh still exists. I refute him thus! . . .

WHERE’S THE CIVIL RIGHTS COMMUNITY ON THIS? Not only are men disproportionately losing their jobs, but they’re also being shortchanged on healthcare: “Per capita health care spending for females was 32 percent more than for males. . . . Except for children, total spending for and by females was greater than that for and by males, for most services and payers. The gender difference in total spending was most pronounced in the elderly, as a result of the longer life expectancy of women.”

NOTHING SAYS “RECOVERY” LIKE A “temporary service help jobs” recovery! “During five of the last six months, the total number of permanent jobs fell. The new unemployment numbers released on Friday weren’t as bad as other recent numbers. There were 39,000 more jobs during November. However, with 39,500 coming from temporary jobs, there would have been essentially no new permanent jobs. . . . The explanation behind temporary job creation is pretty simple: uncertainty. Companies don’t want to make longer-term commitments if they don’t know what the next couple of years will look like. New regulations are being imposed on companies, be it health care, finance, the environment, and the other areas. And the exact form and extent of these regulations still have to be determined by regulators. Many small companies don’t even know what tax rates they will face after the beginning of the year. Neither the president nor the Democratically controlled congress attempted to prevent income tax rates from rising for even the middle class until just a few weeks before they were expected to rise.”

GOOD: U.S. Military in Talks to Share Fireball Data from Secret Satellites. “For decades, the U.S. Department of Defense has operated classified spacecraft loaded with high-tech gear to carry out a range of reconnaissance duties. But the satellites have also spotted the high-altitude explosions of natural fireballs that routinely dive into the Earth’s atmosphere, and talks are under way to offer scientists access to that data.”

RICHARD EPSTEIN: ObamaCare Is Now On The Ropes.

UPDATE: Megan McArdle: “A lot of the bits of the machine aren’t working as predicted; the legal problems are only one issue. Proponents naturally think these are just growing pains, while opponents like me are inclined to be more pessimistic. Only time will tell who’s right, though I must offer one telling point for the prosecution: I’ve yet to see a major story showing how health care reform is working better than expected.”

CHANGE: MEDICAL CARE QUEUES TO GET LONGER. “Even if you have great private health insurance now you won’t in your old age. My advice: plan accordingly. Start preparing for it by accumulating money. . . . You have been warned. What to do about it? Cut your spending and put aside more in retirement accounts. Also, when making career choices go for the money. The utility of money is going to rise with advances in biotechnology. Some extra tens or hundreds of thousands of dollars set aside for medical expenses might save your life.”

FIRST NISSAN LEAF DELIVERED IN SAN FRANCISCO, but what’s up with the next batches? “A glance at the My Nissan Leaf discussion forum shows that there is a lot of confusion over when the bulk of the vehicles will actually be delivered.” As I mentioned before, I signed up early and I’ve been very disappointed with what I’ve been hearing — or not hearing — from Nissan.

Wow, that solves all sorts of problems. You want an abortion, or a school without government sponsored prayer? Get on the subway! Desegregated schools? Same thing! (Why didn’t the Supreme Court think of that in Bolling v. Sharpe? — Oh, right, no subway back then. See, this is why people oppose mass transit. It’s an end-run around the Bill Of Rights . . . .)

FEDERAL COURT: ObamaCare Unconstitutional. “A federal judge declared the Obama administration’s health care law unconstitutional Monday, siding with Virginia’s attorney general in a dispute that both sides agree will ultimately be decided by the U.S. Supreme Court.” Yes, it will be. I’m wondering if a lot of politicians who initially supported ObamaCare are now secretly hoping it is blocked by the courts, getting them off the hook. . . .

JOEL KOTKIN ON class, demography, and what Democrats and Republicans are missing. “The Democrats own the lower income groups and those at the apex of the post-industrial economy – top bureaucrats, most non-profits, established media, Silicon Valley VCs, Wall Street and academia. The Republicans own the old upper class tied to manufacturing (at least the non-subsidized parts), agriculture and fossil fuels. The group in play is the huge, mainly suburban working, middle and upper-middle class. These include managers, store owners, lone entrepreneurs and skilled laborers in the private sector. Neither party focuses on presenting a positive vision for growth and improvement of quality of life for this segment. So people in this group shift back and forth, making havoc of the best laid plans of both parties.”
